The actor was arrested on Thursday for third-degree felony assault stemming from an incident that allegedly took place in the very early morning on January 25.
According to TMZ sources, police responded to a 911 call from a nightclub in Park City (during the Sundance Film Festival) and found Hirsch totally wasted.
Officials say the star "asked [Paramount executive Daniele Bernfeld] why she looked 'so tough' and said she was a 'rich kid' who should not be at Sundance."
After Bernfeld left to go sit at a table with friends, Hirsch supposedly came up from behind and placed her in a “chokehold.”
After that, Bernfeld alleged Hirsch "pulled her across the table and onto the floor" before landing on top of her and choking her to the point that she nearly passed out.
A pair of onlookers finally pulled Hirsch off at this point.
Hirsch, who is due in court on March 16, was charged with felony aggravated assault, which is punishable by up to five years in jail.
In response to the incident, Hirsch's rep tells TMZ:
"Regarding the charges that have been brought against Emile today, the facts that I can relay are that he consumed an enormous amount of alcohol on the evening in question and he has no memory of what happened.
"Emile takes these allegations very seriously, and is devastated that any of this has occurred. A few days after the incident, Emile sought help and checked himself into an alcohol rehabilitation facility, where he remains today, to ensure nothing like this ever happens again."
